Mitchell A. Herigstad joined the Firm as an associate in 1994, becoming a partner in 1999.  Mitch's practice focuses on, but is not limited to, Information Technology Law, Business Law, Corporate Law, Wills, Trusts, Estate Planning & Probate Law,  and Taxation.

Mitch was born in Seattle, Washington, and raised in San Mateo, California, and later in Bloomington (Minneapolis), Minnesota.  He attended the University of St. Thomas in St. Paul, Minnesota, earning a Bachelor of Arts in Political Science and a Minor in Philosophy.  Mitch was awarded his Juris Doctor from the Drake University Law School in Des Moines, Iowa in 1994.

Mitch is admitted to practice law in Iowa and South Dakota. He is also admitted to practice in the United States District Court for the Northern and Southern Districts of Iowa and the United States Tax Court. He is a member of the Commercial/Bankruptcy; E-Commerce; Intellectual Property; and Probate Sections of The Iowa State Bar Association. Mitch is active in the Sioux City community and in his free time enjoys baseball, boating, technology, history, and music.

Corporate and Commercial Transactions

  • Focusing on advising small to medium-sized businesses, business owners, and outside investors in entity formation, operation, acquisitions, and liquidation

  • Extensive skill in the drafting, negotiating, and implementing of all forms of organizational, operational, transactional agreements and contracts
  • Mitch has advised clients from the smallest of startups to those with over $1 billion in revenues
  • Transactions Mitch has handled range from small one-off to enterprise-wide procurements in the tens of millions

Estates and Trusts

  • Counseling individuals and their families in the development and implementation of estate planning strategies to plan for the tax efficient distribution of their assets, during their lifetime and upon their deaths, while meeting family succession goals with particular expertise in the preparation of sophisticated estate planning documents
  • Advising corporate and individual executors, administrators, and personal representatives
  • Guiding clients through the probate and estate tax audit process to promptly and efficiently settle an estate
  • Providing counsel to trustees and beneficiaries in a wide variety of trusts
  • Mitch's clients range from those needing simple Wills to the development and long-term implementation of sophisticated estate plans for high net-worth clients and their families for successive generations

Technology Transactions

  • Counseling, drafting, and negotiating IT infrastructure acquisitions and related agreements including hardware/systems procurements (purchase and lease) and divestitures
  • Guiding clients with software (and maintenance) procurements and licenses, ranging from small off-the-shelf commercial software to enterprise level software
  • Assisting clients with technology services and consulting agreements; intranet access agreements; communications and data center/hosting agreements; employee computer/security policies; website privacy and terms of use policies; and confidentiality and proprietary rights agreements
